SHIPPING & DELIVERY

Quantum’s preferred shipper is Fed Ex, but we can use UPS and USPS by request. We can also ship using your carrier account as requested.

Orders placed Monday through Friday (excluding holidays) will be processed and shipped within 1 day once credit card authorization or account and verification have been obtained. Orders placed on Saturdays and Sundays will begin processing the following business day. All customers will receive a confirmation email with tracking information when the order has shipped. All custom pieces ordered (in the case of point of purchase print material) will ship within 15 business days of an order being processed. Orders submitted before 12PM PST with Overnight or Two-Day shipping methods selected will ship the same business day. Orders placed after 12PM PST or Saturday and Sunday will ship the next business day.

All orders are shipped via FedEx or United Parcel Service (please note that FedEx and UPS do not ship to P.O. Boxes). The following shipping methods are in effect during this time:

  • Ground(will arrive in 3-5 business days)
  • Two-Day (will arrive in 2 business days)
  • Express Saver (will arrive in 3 business days)
  • Overnight (will arrive the following business day)
  • International: All orders shipping internationally are subject to additional shipping charges based on taxes, tariffs and duties put into place by that country.  Quantum Innovations, Inc. is not associated with these fees.  All fees are to be paid for by the customer at the time of delivery.

Order Tracking

If a tracking # is provided by the shipping carrier, we will update your order with the tracking information.

Shipping Rates

The rate charged for the shipping of your order is based on the weight and dimension of your products, special handling extras (hazardous materials) and your location.

Delivery Mistakes and Problems

If there is a problem or error with a delivery, please contact Quantum for an RMA right away (see Returns and Replacements section for more detail). We retain tracking numbers for all shipments. We also maintain a secure database of customer addresses. If a mistake was made and Quantum Innovations, Inc. is responsible, we will correct out of our cost. If the mistake was made by the shipping carrier, they are responsible for all additional costs but we will work with you to have the issue resolved quickly and completely. If the mistake was the error of the customer, we will do our very best to assist you in completing a successful delivery but the customer will be responsible for all additional fees including the total cost of the order.

Refused Shipments

All products returned to Seller due to refusal of acceptance by Buyer, without Seller's authorization, will be subject to a 25% restocking and transportation charge.

Quantum Innovations, Inc. has prepared this Privacy Policy to help you understand more about how we collect, use, and disclose information that we collect about consumers through our web and mobile services, which we refer to in this Privacy Policy collectively as the “Services.”

We use the information that we collect about you for these purposes:

With whom do you share this information?

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information.

We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

It may become accessible through search engines or, if you sign in using credentials from a third-party social networking service, to users on that service. Unless otherwise noted, we do not limit the distribution of information that you share using these features.

How do you protect the security of the information you store?

We have in place physical, electronic, and managerial procedures to protect the information we collect through the Services. We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. However, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us via the Services. Please refer to the U.S. Federal Trade Commission’s website for information on how to protect yourself from identity theft.

Do you collect information from children?

We do not knowingly collect personally identifiable information from children under the age of 13. If we learn that we have collected any personal information from a child under the age of 13 without verification of parental consent, we will delete that information from our database promptly.

What are my California privacy rights?

California law permits residents of California to request certain details about what personal information a company shares with third parties for the third parties’ direct marketing purposes. Qtmi.net DOES NOT share personal information with third parties.

What are cookies and web beacons and how are they used on the Services?

We may use cookies and other technologies to store information on your computer or mobile device. We use this information for a variety of purposes, such as to remember you when you return to our websites or to identify your activities as you use certain Services. To do this, we may store a unique identifier on your computer or device.

You may opt-out of the browser cookies delivered through the Services by changing the setting on your browser. Please be aware that this will disable all cookies delivered to your browser, not just the ones that we deliver, and that you may not be able to use all of the Services if you do not allow the placement of cookies.

Please note that, because these opt-out tools will place a cookie on your computer to record your opt-out preference, any actions you take using these tools will apply only to the web browser that you use to take the action. Sharing of information collected online. Please understand that it may take us a reasonable amount of time to cancel your registration after we receive your request and that your cancellation will not apply to our uses of information about you prior to our receipt of the request. Is my data transferred internationally?

Quantum Innovations, Inc. is headquartered in the United States. Please be aware that information you provide to us or we obtain as a result of your use of the Services may be collected in your country and subsequently transferred to the United States or another country in accordance with applicable law. The privacy and data protection laws in another country may not be equivalent to such laws in your country of residence. By using and participating in the Services or providing us with your information, you consent to the collection, international transfer, storage, and processing of your information.

RETURNS & REPLACEMENTS

Goods will not be accepted for return without a Quantum Innovations, Inc. return authorization number (RMA).

Claims for damages and shortages must be within 30 days of the date of delivery.

There are absolutely no returns or exchanges allowed after 30 days of receiving date.  Unsatisfactory product may be exchanged within 30 days only.

Please contact Quantum Innovations, Inc. for return authorization at 541-608-7772 or e-mail sales@qtmi.net.  Please do not return merchandise without prior authorization, for the package will get refused.  Special design and custom constructed or custom formulated merchandise are not returnable.

ORDERING

All orders are accepted in accordance with the terms and conditions set forth herein.  Following acceptance by Quantum Innovations, Inc., orders are not subject to cancellation or modification except with the written approval of Quantum Innovations, Inc. and shall be subject to all applicable cancellation charges.  Quantum Innovations, Inc.  reserves the right to correct any typographical errors.  All orders placed by you whether over the internet, telephone or in written form are binding and legally enforceable contracts.  You agree are wholly responsible for the actions of your employees, agents or representatives.  If an employee of yours places an order, you are responsible for the employee’s actions and you assume all responsibilities whether authorized or not.

Your receipt of an electronic or other form of order confirmation does not signify Quantum Innovations, Inc.’s acceptance of your order, nor does it constitute confirmation of the order.  Quantum Innovations, Inc. reserves the right, without prior notification, to accept or decline your order or limit the order quantity for any reason.  For credit card payments, such payment is subject to the approval of the financial institution issuing the credit card and Quantum Innovations, Inc. shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason.  Quantum Innovations, Inc. may require, at its option, that any order placed over certain dollar amounts receive pre-approval.  Quantum Innovations, Inc. also may require additional verification or information before accepting any order.

Back Orders

If an item goes on back order, we will ship you the part of your order that is in stock. When the item becomes available we will ship you the rest of your order. You will not be charged any additional shipping and handling for the second shipment.

PAYMENT, PRICING & PROMOTIONS

Methods of Payment

Accounts in good standing with prior approval may pay for orders “on account.” In this case, our accounting department will invoice you for the goods and serves rendered.

Payment may also be made with major credit cards issued in the United States of America. Currently, we accept Visa, Master Card, America Express and Discover. Generally, credit and debit cards are not charged until we confirm store availability (at which time you will be charged only for the goods we have actually have in stock along with any appropriate taxes or shipping charges). However, we may pre-authorize your order amount with your credit or debit card issuer at the time you place the order, which may have an effect on your available credit line. Please contact your credit card issuer for more information.

Pricing

Online prices, printed catalog pricing, published advertisement pricing, contract discounts and all other offers and selections may vary and are subject to change at any time.

Typographical Errors: In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Quantum Innovations, Inc. shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Quantum Innovations, Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Quantum Innovations, Inc. shall immediately issue a credit to your credit card account in the amount of the charge.

The following Terms of Use (“Terms”) govern your access to and use of the Services. These terms are a legal contract between you and QTMI, so it is important that you review them carefully before using the Services. Upload or otherwise transmit any communication, software, or materials that contain a virus or is otherwise harmful to QTMI or its users’ computers or systems; or

Access the Services through any automated means, including “robots” and “spiders.”

5. Third-Party Content and Links to Third-Party Websites

The Services may contain third-party owned content and advertisements (“Third-Party Content”) and links to other websites (“Linked Sites”). QTMI does not endorse, sponsor, recommend, or otherwise accept responsibility for any Third-Party Content or Linked Sites. You acknowledge that Third-Party Content and Linked Sites are not under the control of QTMI, and QTMI is not responsible for the content or privacy practices of the Third-Party Content or Linked Sites.

6. User Submissions

The Services may offer features that allow users to post content and communicate with others. This content may include text, images, photographs, audio, video, or material in any other form (collectively, “User Submissions”). By submitting any User Submission on, to, or through the Services, you understand and agree that:

A. You will not post content that:

  • infringes on the rights (including copyright, trademark, patent, and other intellectual property rights and rights of privacy and publicity) of any third party;
  • is false, misleading, libelous, defamatory, obscene, abusive, hateful, or sexually-explicit;

C. QTMI is not responsible for any content posted by third parties and has no obligation to monitor the content posted. Nevertheless, QTMI may monitor or review any User Submission as it chooses and reserves the right to remove, reject, or revise content that it deems inappropriate or otherwise objectionable for any reason whatever without consent.

D. Except with our prior written consent, you may make User Submissions only for non-commercial purposes. You may not solicit funds, promote commercial entities, or otherwise engage in commercial activity in the content you post.

E. You use and/or rely on any information provided by other users at your own risk. QTMI is not in any manner endorsing the content of the content that users post and cannot and will not vouch for its reliability.

F. You are giving QTMI the worldwide, irrevocable, perpetual, royalty-free, non-exclusive, and fully sublicenseable right and license to display, distribute, reproduce, transmit, publish, perform, translate, edit, adapt, remove, modify, create derivative works from, and otherwise use such User Submissions in whole or in part, including in combination with your name, likeness, or other material, in its sole discretion, including but not limited to on the Services, in any affiliated publications, and in any form, media, or technology now known or later developed, including for promotional and marketing purposes.

7. Intellectual Property

A. Copyright. The Services (including, but not limited to, text, images, photographs, graphics, user interface, screen shots, video and audio content, designs, and computer code, and the selection, coordination, and arrangement of such content) are protected under the copyright laws of the United States and other countries. All copyrights in the Services are owned by QTMI or its third-party suppliers and licensors to the full extent permitted under the United States Copyright Act and all international copyright laws.

Except for content you have posted on the Services, or unless expressly permitted, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of the Services, except that you may download, for your own personal use, one machine readable copy and/or one print copy that is limited to occasional articles of personal interest only. Without limiting the generality of the foregoing, you may not distribute any part of the Services over any network, including a local area network, nor sell or offer it for sale. In addition, you may not use the Services or any content on the Services to construct any kind of database. B. Trademark and Service Mark Rights. All rights in the product names, company names, trade names, logos, service marks, trade dress, slogans, product packaging, and designs of QTMI, QTMI affiliates, or third-party products or services, whether or not appearing in large print or with a trademark symbol, belong exclusively to QTMI or their respective owners, and are protected from reproduction, imitation, dilution, or confusing or misleading uses under national and international trademark and copyright laws. The use or misuse of these trademarks or any materials containing the trademarks, except as permitted herein, is expressly prohibited, and nothing stated or implied on the Services confers on you any license or right under any patent or trademark of QTMI, its affiliates, or any third party. C. Use of Authorized Interface. The Services have been specially designed for presentation of content in a unique format and appearance to our users. We are concerned about the integrity of our Services when they are viewed in a setting created by a third party that includes advertising or other materials that we have not authorized to be displayed with our Services. Without limiting the provisions of this section, neither you nor any third party shall make use of the contents of the Services in any manner that constitutes an infringement of our rights, including copyright, or that has not been authorized by us.

D. Copyright Infringement Claims. Just as QTMI requires users to respect our copyrights, and those of our affiliates and partners, we respect the copyrights of others. When we become aware of allegations of copyright infringement in material distributed on the Services, we will investigate the allegations and take appropriate action. This can include, in the case of individuals who repeatedly infringe the copyrights of others, termination of access privileges.

If you believe in good faith that your copyrighted work has been reproduced or is accessible on the Services without authorization in a way that constitutes copyright infringement or that your intellectual property rights have otherwise been violated, please provide QTMI’s Designated Agent with the following information in writing:

  • Identification of the copyrighted work or other intellectual property claimed to have been infringed;
  • Identification of the allegedly infringing material, reference, or link that is to be removed and information reasonably sufficient to permit QTMI to locate the material, reference, or link;
  • Your name, address and daytime telephone number, and an e-mail address if available, so that QTMI may contact you if necessary;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

8. Indemnification

You agree to indemnify and hold harmless QTMI, its affiliates, and each of their directors, officers, managers, employees, shareholders, agents, licensors, and contractors, from and against all claims, demands, disputes, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising out of or in relation to these Terms or your use of the Services. QTMI reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.

9. Disclaimer of Warranties

THE SERVICES – AND ANY PRODUCTS THAT ARE OFFERED THROUGH THE SERVICES (“PRODUCTS”) – ARE AVAILABLE “AS IS.” QTMI MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND WHATSOEVER RELATING TO THE SERVICES, PRODUCTS, LINKED SITES, OR OTHER CONTENT THAT MAY BE ACCESSIBLE DIRECTLY OR INDIRECTLY THROUGH THE SITE. QTMI DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, QTMI DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL (A) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (B) WARRANTIES AGAINST INFRINGEMENT OF ANY THIRD-PARTY INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS, (C) WARRANTIES RELATING TO THE TRANSMISSION OR DELIVERY OF THE SERVICES, (D) WARRANTIES RELATING TO THE ACCURACY, RELIABILITY, CORRECTNESS, OR COMPLETENESS OF DATA MADE AVAILABLE ON THE SERVICES OR OTHERWISE BY QTMI, AND (E) WARRANTIES OTHERWISE RELATING TO PERFORMANCE, NONPERFORMANCE, OR OTHER ACTS OR OMISSIONS BY QTMI OR ANY THIRD PARTY. FURTHER, THERE IS NO WARRANTY THAT THE SERVICES – OR PRODUCTS OFFERED THROUGH THE SERVICES – WILL MEET YOUR NEEDS OR REQUIREMENTS OR THE NEEDS OR REQUIREMENTS OF ANY OTHER PERSON.

QTMI MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, (A) THAT THE INFORMATION PROVIDED THROUGH THE SERVICES WILL BE FREE FROM ERROR, OMISSION, INTERRUPTION, DEFECT, OR DELAY IN OPERATION, OR FROM TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS; (B) THAT THE SERVICES OR PRODUCTS WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (C) THAT DEFECTS OR ERRORS IN THE SERVICES OR PRODUCTS WILL BE CORRECTED; OR (D) THAT THE CONTENT ON THE SERVICES IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY INFORMATION ON THIS SERVICE IS SUBJECT TO CHANGE WITHOUT NOTICE, AND QTMI DISCLAIMS ALL RESPONSIBILITY FOR THESE CHANGES.

10. Limitation of Liability

UNDER NO CIRCUMSTANCES WILL QTMI, ITS AFFILIATES, AND THEIR DIRECTORS, OFFICERS, MANAGERS, EMPLOYEES, SHAREHOLDERS, AGENTS, LICENSORS, CONTRACTORS, OR ANY PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES, BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING LOST REVENUES OR PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, ARISING OUT OF YOUR USE OF THE PRODUCTS OR YOUR ACCESS, USE, MISUSE, OR INABILITY TO USE THE SERVICES OR ANY LINKED SITES, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, LINE OR SYSTEM FAILURE, OR OTHER INACCURACIES IN THE SERVICES (INCLUDING WITHOUT LIMITATION AS A RESULT OF BREACH OF ANY WARRANTY OR OTHER TERM PROVIDED IN THESE TERMS).

IN THE EVENT THAT YOU HAVE A DISPUTE WITH ANOTHER PERSON OR ENTITY RELATED TO, ARISING FROM, OR IN ANY WAY CONNECTED WITH USE OF THE SERVICES, YOU RELEASE QTMI FROM ANY CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND AND NATURE ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH A DISPUTE.

THESE LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF QTMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. ANY CLAIM AGAINST US SHALL BE LIMITED TO THE AMOUNT YOU PAID, IF ANY, FOR USE OF THE SERVICES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, QTMI’S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, QTMI DISCLAIMS ALL LIABILITY OF ANY KIND ARISING FROM THE UNAUTHORIZED ACCESS TO OR USE OF YOUR PERSONAL INFORMATION.

11. Arbitration of Claims

Any claim that you might have against QTMI must be resolved through binding arbitration before the American Arbitration Association using its Commercial Arbitration Rules and must be brought within one year of the claim arising. You understand and agree that you will arbitrate with QTMI in your individual capacity, not as a representative or member of a class. Your claim may not be joined with any claim of any other person, and there shall not be authority for any dispute to be arbitrated on a class-action basis.

You understand and agree that unless you can demonstrate to QTMI that arbitration in Oregon would create an undue burden for you, any arbitration hearing will be held in Jackson County, Oregon. If your claim is successful in arbitration, QTMI agrees to reimburse your reasonable attorneys’ fees and costs.

12. Miscellaneous

These Terms, including any materials linked from the Terms are the entire agreement between you and QTMI concerning your use of the Services. These Terms supersede any prior agreements (whether oral, written, or electronic) concerning your use of the Services, including agreements with QTMI’s affiliates or predecessors-in-interest.

The failure of QTMI to enforce any provision(s) of these Terms or respond to a breach by any party shall in no way waive QTMI’s right to subsequently enforce any of these Terms or respond to any breaches.

These Terms shall be governed by the laws of the United States and the State of Oregon, without reference to its choice of law rules, as if entered into by parties located in Oregon and performed fully therein. You agree that any claim or dispute against QTMI arising out of or relating to these Terms or the use of the Services must be brought within one year after such claim or dispute first accrues. You further agree that any such claim or dispute must be brought in a court located in Jackson County, Oregon unless agreed upon by all parties, and you agree to submit to the exclusive personal jurisdiction and venue of such courts.

If any portion of these Terms is found to be invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intention of the parties, and the remaining portions shall remain in full force and effect.

Nothing contained in these Terms is in derogation of QTMI’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Services or information provided to or gathered by QTMI with respect to such use.

QTMI shall have the right to assign, transfer, and sublicense these Terms, and its rights and obligations hereunder, to one or more other persons or entities.

QTMI may terminate this agreement for any reason at any time. QTMI reserves the right, in its sole discretion, to restrict, suspend, or terminate your access to and use of the Services, with or without prior notice. Sections Four (4), Six (6), Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11) and Twelve (12) of these Terms shall survive such termination.
